Wilson v. State

District Court of Appeal of Florida, Fourth District
Jun 27, 1984
451 So. 2d 1050 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-426.

June 27, 1984.

Appeal from Circuit Court, Broward County; John G. Ferris, Judge.

Richard L. Jorandby, Public Defender, and Allen J. DeWeese, Asst. Public Defender, West Palm Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Richard G. Bartmon, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm appellant's conviction. We remand for correction of sentencing in that (1) the maximum fine is $25,000 rather than $50,000 (and no fine of any amount appears on the written Sentence); (2) the three year minimum mandatory sentence should be imposed under Section 893.135(1)(a)1 rather than Section 775.087(2) Florida Statutes (1983).

AFFIRMED IN PART; REVERSED IN PART; REMANDED WITH INSTRUCTIONS.

HERSEY, GLICKSTEIN and DELL, JJ., concur.
