Court Below: Family Court of the State of Delaware in and for New Castle County, File No. 96-10235, Petitioner and Petition Nos. 97-14363, 15348, Counter Respondent and 23754

AFFIRMED.

Before WALSH, HOLLAND, and HARTNETT, Justices.

ORDER

This 24th day of February, 1999 upon consideration of the briefs of the parties we conclude that the Family Court's decision of May 11, 1998 continuing joint custody between the parties represents a proper exercise of discretion, in full consideration of the factors set forth in 13 Del. C. § 722(a). We further conclude that the Family Court did not abuse its discretion in the denial of counsel fees to the parties. Accordingly, this matter is affirmed as to both the appeal and the cross appeal.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Family Court be, and the same hereby is, AFFIRMED.

BY THE COURT:

/s/ Joseph T. Walsh, Justice
