This case was abated for bankruptcy on July 10, 2014. On March 5, 2024, the Clerk of this Court issued a notice that through the Public Access to Court Electronic Records (PACER) system, the Court had learned that the bankruptcy court signed an order closing the bankruptcy case. The Court advised the parties that, unless any party filed a motion to reinstate the appeal with a certified copy of the order, or otherwise responded why the case should not be reinstated, the Court might reinstate the appeal on the active docket. This response was due by April 4, 2024 and no response was filed.
Because no response was filed, the Court ordered the appeal reinstated on the active docket. The Court also ordered the reporter's record filed within 30 days. On June 13, 2024, the court reporter advised that there was no reporter's record to be prepared and filed.
Accordingly, the Court will consider and decide those issues or points that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c) (stating that, if clerk's record has been filed, appellate court may consider and decide those issues or points that do not require a reporter's record).
Appellant's brief must be filed no later than 30 days after the date of this order.
Appellees' brief will be due within 30 days after appellants' brief has been filed.
