STIPULATION OF DISMISSAL; ORDER THEREON
IT IS HEREBY STIPULATED by and between Plaintiff RONALD WILSON ("Plaintiff"), on the one hand, and Defendant MACERICH PROPERTY MANAGEMENT COMPANY LLC (erroneously sued and served as Macerich Company and Macerich Management Company) ("Defendant"), on the other hand, through their respective attorneys of record, that Plaintiff and Defendant have agreed to resolve this case by way of settlement. Plaintiff and Defendant have executed a Settlement Agreement And Release In Full (the "Agreement").
The parties further stipulate that the Court shall retain jurisdiction over all disputes between Plaintiff and Defendant including, but not limited to, interpretation and enforcement of the terms of the Agreement until December 30, 2004. The terms of the Agreement are hereby incorporated in this Stipulation and Order. Plaintiff and Defendant further stipulate, pursuant to Federal Rule of Civil Procedure 41(a)(1), that this Court dismiss Plaintiff's Complaint in this action in its entirety. Each party shall bear his and/or its own costs and attorney's fees, except as otherwise set forth in the Agreement.
IT IS SO STIPULATED.
ORDER ON STIPULATED DISMISSAL WITH PREJUDICE
IT IS HEREBY ORDERED that the Court shall retain jurisdiction over all further proceedings in this matter including, but not limited to, interpretation and enforcement of the terms of the Settlement Agreement And Release In Full (the "Agreement") until December 30, 2004. The terms of the Agreement are hereby incorporated in this Order.
IT IS FURTHER ORDERED that the Complaint of Plaintiff RONALD WILSON in USDC Case Number C 02-03632 MMC is hereby dismissed with prejudice in its entirety. Each party shall bear his and/or its own costs and attorney's fees, except as otherwise set forth in the Agreement.
IT IS SO ORDERED.
