The order of the Labor Relations Commission dismissing the charge is vacated. The matter is remanded to the commission for consideration of whether the union's representation precluded the employee from presenting the evidence of mitigation set forth in his affidavit, whether that constituted a breach of the duty of fair representation, and whether the matter should proceed to complaint.
