ΒΆ 89 The Fifth Amendment privilege against self-incrimination "protects one accused of a crime from providing the state with evidence of a testimonial nature." Wilson v. Indus. Comm'n , 730 P.2d 911, 913 (Colo. App. 1986). Thus, a criminal defendant has the right to remain silent during custodial interrogations and to not testify against himself at trial.
