On order of the Court, the application for leave to appeal from the November 5, 1999, decision of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Worker's Compensation Appellate Commission for reconsideration in light of Mudel v Great Atlantic Pacific Tea Co, 462 Mich. 691 (2000).

We do not retain jurisdiction.

Cavanagh and Kelly, JJ., would deny leave to appeal.
