ORDER

Lewis R. Carluzzo, Chief Special Trial Judge.

This case for the redetermination of a deficiency, presently set for trial during the Dallas, Texas, trial session scheduled to begin in that city on September 9, 2024, is before the Court on respondent's motion to dismiss, filed August 16, 2024.

Giving due regard to the representation contained in that motion, it is

ORDERED that respondent's motion is set for hearing when the case is called from the calendar at the time, date and place shown in the Notice Setting Case for Trial, served April 9, 2024.

Petitioner is advised that the failure to appear at the hearing could result in the entry of decision as requested in respondent's motion.
