SUPPLEMENTAL: Appellant Brown has accelerated the filing of his brief and states that "acceleration of this appeal would allow for expeditious resolution of this critical issue and thereby further the public interest". Appellant Katz seeks "adequate time" to file her brief, although indicating that she will "make every effort to file her brief earlier than the 45 days" permitted by the rules. Plaintiff, who seeks disclosure of the documents now subject of the stay, is concerned about being required to file a brief too expeditiously while Brown had since the entry of judgment to prepare and file his brief on the appeal. All parties seem to recognize the need for accelerated and expeditious consideration of the appeal after a fair opportunity to brief the merits.
In light of the position of the parties and the time that has passed since entry of the judgment of June 27, 2008, and recognizing that the appellant Brown's brief and the transcripts were filed on August 8, 2008, it is ORDERED that the brief of Carla Katz as appellant, shall be served and filed on or before September 25, 2008. Plaintiff Wilson and amicus curiae Communication Workers of America may each respond to the brief of both appellants in a single brief on or before October 27, 2008, and appellants may file their reply briefs within 10 days thereafter.
The appeals shall be argued at 9:30 a.m. on Thursday, November 13, 2008, in the Appellate Division courtroom in Morristown.
