ORDER APPROVING STIPULATION FOR JUDGMENT FOR
NONDISCHARGEABILITY
Upon consideration of the Stipulation for Judgment for Nondischargeability filed herein, and good cause appearing therefor,
IT IS HEREBY ORDERED, ADJUDGED, AND DECREED THAT:
1. The Stipulation for Judgment for Nondischargeability ("Stipulation") is hereby approved.
2. Gary Rosen, Esq., THE CHAPTER 7 TRUSTEE shall have judgment against defendant JEAN G. BALLA on behalf of all creditors in the sum of Thirty-five Thousand Dollars ($35,000.00)(the "Judgment Sum").
3. Jean G. Balla shall pay a sum of Eight Thousand Five Hundred Dollars ($8,500.00) (the "Settlement Sum"),
4. Provided the sum of Eight Thousand and Five Hundred Dollars ($8,500.00) is paid in accordance with the terms of the Stipulation, the Judgment will be satisfied in full and a satisfaction of judgment will be filed in favor of Jean G. Balla.
5. In the event that the defendant fails to make the payments as and when due and within ten (10) business days thereafter without notice from the Chapter 7 Trustee, then the Chapter 7 Trustee may enforce the Judgment in the Judgment Sum, less payments made, plus interest at the federal civil judgment rate on the declining balance of the Judgment Sum from the date of entry of the Judgment, plus any attorney's fees incurred in enforcing the Judgment.
6. The obligation of this Judgment shall be nondischargeable under § 523(a)(2)(A), 11 U.S.C. § 727(a)(2) and 11 U.S.C. § 727(a)(4).
7. The parties shall bear their own fees and costs herein.
