Order of the Special Term modified so as to provide as follows: If the defendant, within twenty days after the due taxation of plaintiff's costs and notice thereof, shall pay the same, the motion is denied. If said costs shall not be so paid, the motion is granted. The order appealed from, as so modified, affirmed, without costs. No opinion. All concurred.
