In an action to recover damages for fraud, the above-named defendants appeal from an order of the Supreme Court, Westchester County, dated May 8, 1961, denying their motion, pursuant to rule 156 of the Rules of Civil Practice, to dismiss the amended complaint for failure to diligently prosecute the action. Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Beldock, Kleinfeld, Christ and Pette, JJ., concur.
