MEMORANDUM OPINION


Appellant filed a notice of appeal on April 24, 2008. Appellant filed a deficient brief on June 11, 2008. By letter dated September 15, 2008, we notified appellant that his brief was deficient and directed him to file a brief complying with Texas Rule of Appellate Procedure 38.1 by September 25, 2008.

On October 16, 2008, we ordered appellant to file an amended brief complying with Texas Rule of Appellate Procedure 38.1 by October 26, 2008. We advised appellant that no further extension of time for appellant to file his amended brief would be entertained by the Court. We further advised appellant that if appellant's amended brief complying with rule 38.1 was not filed by October 26, 2008, we would dismiss this appeal for want of prosecution. See Tex. R. App. P. 42.3(b) and (c).

To date, appellant has not filed an amended brief complying with rule 38.1.

Accordingly, we DISMISS this appeal for want of prosecution. See Tex. R. App. P. 42.3(b) and (c).
