JUDGMENT


The court has entered its order adopting the findings, conclusions and recommendation of the United States Magistrate Judge (the "Findings") in this case.

It is therefore ORDERED, ADJUDGED, and DECREED that the petition is DISMISSED with prejudice as barred by the one-year limitation period pursuant to 28 U.S.C. § 2244(d).

The clerk shall transmit a true copy of this Judgment, together with a true copy of the Order adopting the Findings, to the parties.
