ORDER ADOPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, the Court finds that the findings and conclusions of the Magistrate Judge are correct and they are adopted as the findings and conclusions of the Court.

JUDGMENT

The Court has heretofore entered its Order adopting the Findings, Conclusions and Recommendation of the United States Magistrate Judge in this case.

It is therefore ORDERED, ADJUDGED and DECREED that Plaintiffs § 1983 claims are dismissed with prejudice to their being reasserted until the Heck v. Humphrey conditions are met.

It is further ORDERED that the Clerk shall transmit a true copy of this Judgment, together with a true copy of the Order adopting the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, to the parties.
