David Lee WILLINGHAM, Appellant v. The STATE of Texas, Appellee

From the 175th Judicial District Court, Bexar County, Texas
Trial Court No. 2010CR10435
Honorable Catherine Torres-Stahl, Judge Presiding

ORDER

Appellant's brief was originally due on October 6, 2017. When appellant's brief was not filed, the Clerk of this Court sent appellant's attorney, James Reeves, a letter informing him that appellant's brief had not been filed. On October 30, 2017, appellant's attorney filed a motion for extension of time to file appellant's brief, requesting an additional sixty days to file the brief. We granted the motion and ordered appellant's attorney to file the brief on or before December 5, 2017. However, we explained that no further extensions would be granted. Despite our order, appellant's attorney has failed to file appellant's brief.

We ORDER appellant's attorney, James Reeves, to file appellant's brief on or before January 17, 2018. If appellant's brief is not filed by that date, we will abate this appeal to the trial court for an abandonment hearing. TEX. R. APP. P. 38.8(b)(2). Contempt proceedings may also be initiated against appellant's attorney. Id. 38.8(b)(4).

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 2nd day of January, 2018.
