JUSTICE OF THE PEACE, 201when circuit court does not abuse its discretion in refusing to set aside order dismissing appeal from justice. In light of affidavits presented to circuit court, held that it could not be said that such court abused its discretion in refusing to set aside its order dismissing appeal from justice of peace for want of prosecution.

Appeal from Circuit Court of Madison county; Hon. MAURICE V. JOYCE, presiding.

Affirmed. Heard in this court at October term, 1942.
