Williams v. State

Supreme Court of Arkansas
May 5, 2011
2011 Ark. 197 (Ark. 2011)

Opinion

CR 93-988, CR 99-1221

Opinion Delivered May 5, 2011

Motion for Stay of Execution, Granted.

Petitioner, Frank Williams, Jr., moves this court for a stay of execution, which is scheduled for June 22, 2011. In Singleton v. Norris, 332 Ark. 196, 964 S.W.2d 366 (1998), we set out criteria for a stay of execution. There, we explained that where appeals are involved, Arkansas Code Annotated section 16-90-506(c)(3) grants this court the power to suspend execution of the judgment of death. Id. at 200, 964 S.W.2d at 367. Because two appeals involving constitutional issues are pending in this court, we grant the stay.

Motion for stay of execution granted.

CORBIN, J., not participating.
