Williams v. State

District Court of Appeal of Florida, Fifth District
Feb 28, 1991
574 So. 2d 1232 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-1687.

February 28, 1991.

Appeal from the Circuit Court for St. Johns County; Richard O. Watson, Judge.

James B. Gibson, Public Defender, and Paolo G. Annino, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and James N. Charles, Asst. Atty. Gen., Daytona Beach, for appellee.

This is an Anders appeal. The judgments and sentences are affirmed. However, we note a scrivener's error in the written judgment listing burglary of a dwelling as a third degree felony. It should be shown as a second degree felony.

Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967).

AFFIRMED in part; REMANDED for correction of judgment.

W. SHARP, HARRIS and GRIFFIN, JJ., concur.
