We REINSTATE this case.

Before us is appellant's February 9, 2024 request for an extension of time to file his brief. We GRANT appellant's motion and ORDER appellant's brief filed as of the date of this order. We set aside our January 7, 2024 order directing the trial court to conduct a hearing on the record to determine why appellant's brief has not been filed.

We DIRECT the Clerk to send copies of this order to the Honorable Jennifer Bennett, Presiding Judge, 265th Judicial District Court; and counsel for all parties.
