Balaban, hereby stipulate that Plaintiff's Complaint in the instant action shall be dismissed with prejudice, each party to bear their own costs and attorney's fees.

IT IS SO ORDERED. IT IS FURTHER ORDERED that all pending motions are DISMISSED as moot. The Clerk of Court is instructed to close the case.
