JONAS WILLIAMS v. THE STATE OF LOUISIANA AND THE BOARD OF PAROLE OF THE DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONS


In Re: The State of Louisiana, through the Department of Public Safety and Corrections, Office of Probation and Parole, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 620942. BEFORE: WHIPPLE, C.J., GUIDRY, McCLENDON, WELCH AND THERIOT, JJ.

WRIT GRANTED. After a de novo review, we find that the respondent, Jonas Williams, failed to state a cause of action. Accordingly, the January 9, 2017 ruling of the district court denying the peremptory exception of no cause of action filed by the State of Louisiana through the Department of Public Safety and Corrections, Office of Probation and Parole, is reversed, and the exception of no cause of action is sustained. This matter is remanded to the district court with instructions that an order be issued to Jonas Williams, affording him the opportunity to state a cause of action, if possible, within a delay deemed reasonable by the district court pursuant to La. Code Civ. P. art. 934.
