OPINION


Sgt. C. Rodriguez is the remaining defendant in this case after the dismissal of the action as to two of the defendants. Rodriguez was served with process on August 13, 1999. The return of service was filed with the court on September 3, 1999 and shows that Rodriguez was served at the Ulster Correctional Facility, Napanock, New York.

No answer has been filed on behalf of Rodriguez. Plaintiff has now moved for entry of a default judgment.

The court directs that an answer be served and filed on behalf of Rodriguez no later than December 8, 2000. If this is not done, the default judgment will be entered.

SO ORDERED.
