STIPULATION AND PROPOSED ORDER TO TRANSFER VENUE TO THE EASTERN DISTRICT OF CALIFORNIA PURSUANT TO 28 U.S.C. § 1406
IT IS HEREBY STIPULATED AND AGREED by and between Plaintiffs Paul Williams, II and Daylyn Presley and Defendants Michael L. Ramsey, SHERIFF SCOTT A. MACKENZIE, DET. JACK B. STORNE, MARY ANNE HOUX, ROBERT J. BEELER, JANE DOLAN, CURT JOSIASSEN, KIM YAMAGUCHI, DET. RICK HAMILTON, DET. EVAN ATTAWAY, GUY GEORGIANNA, GARY DEMMING, JOS VAN HOUK, SGT. JOHN KUHN, LT. WILLIAM ANDERSON, DET TONY BORGMAN, and HARLEY LEIGHTY that the First Amended Complaint and the allegations of fact contained therein are not based solely upon diiversity of citizenship. The parties further stipulate that a substantial part of the events or omissions giving rise to the First Amended Complaint occurred in the Eastern Judicial District,
In light of the foregoing, the parties hereby stipulate that venue pursuant to 28 U.S.C. § 1391(b) is appropriately had in the Eastermn Judicial District. of California. Thus, the parties further stipuhate that Civil Action No. C-02-1756 SI filed in the United States District Court for the Northern District of California, should be transferred, pursuant to 28 U.S.C. § 1406(a), to the Easterner Judicial District.
IT IS HEREBY ORDERED that pursuant to 28 U.SC. 51406(a), Civil Action C 02-1756 SI, filed in the United States District Court for the Northern District of California, be transferred to the United States District Court for the Eastern District of California
