TERRY L. WILLIAMS v. JOHN J. O'BRIEN, COMMISSIONER OF PROBATION & another.

NOTICE: Decisions issued by the Appeals Court pursuant to its rule 1:28 are primarily addressed to the parties and, therefore, may not fully address the facts of the case or the panel's decisional rationale. Moreover, rule 1:28 decisions are not circulated to the entire court and, therefore, represent only the views of the panel that decided the case. A summary decision pursuant to rule 1:28, issued after February 25, 2008, may be cited for its persuasive value but, because of the limitations noted above, not as binding precedent.

MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The plaintiff appeals the dismissal, pursuant to Mass.R.Civ.P. 12(b)(6), 365 Mass. 754 (1974), of his civil rights complaint against the defendants.

Upon review of the briefs, appendices, and the motion judge's memorandum of decision, we do not discern anything that would cause us to disturb the judgment entered. See Robinson v. Commonwealth, 32 Mass. App. Ct. 6, 10 (1992); Laubinger v. Department of Rev., 41 Mass. App. Ct. 598, 602 (1996).

In any event, apart from the plaintiff's failure to state any plausible legal claim for relief, it has not been made to appear on this record that the plaintiff's CORI is now incorrect.

Accordingly, we affirm based substantially on the reasoning and analysis of the motion judge and pages 4-17 of the defendants' brief. Judgment affirmed.

By the Court (Cypher, Brown & Fecteau, JJ.),
