On June 23, 2023, we abated this appeal pending the outcome of related trial court proceedings. Those related trial court proceedings are currently pending before this court in Cause Number 04-23-00858-CV.
On October 4, 2023, appellant filed a motion to lift the abatement in this case. After consideration, we GRANT appellant's motion to lift the abatement, and we REINSTATE this appeal to our active docket.
On November 14, 2023, appellant filed an opposed motion to consolidate this appeal with Cause Number 04-23-00858-CV. After consideration, we DENY appellant's motion to consolidate.
Appellant previously filed a November 13, 2023 motion to consolidate that indicated appellee was not opposed to consolidation. Because appellant's November 14, 2023 opposed motion appears to be an amendment of the earlier filed motion, we do not consider the earlier filed motion.
Appellant's brief in this appeal is due by February 8, 2024.
