ORDER WITHDRAWING REPORT AND RECOMMENDATION AND FINDING PLAINTIFF'S IN FORMA PAUPERIS MOTION TO BE MOOT


On November 7, 2003, the Magistrate Judge issued a Report and Recommendation that plaintiff be denied pauper status based on the financial disclosures made to the Court.

On November 25, 2003, plaintiff responded by paying the filing fee. Consequently, the Report and Recommendation issued April 25, 2001, is WITHDRAWN.

Because plaintiff has paid the filing fee, his motion to proceed in forma pauperis is MOOT and no further ruling will issue.

IT IS SO ORDERED.
