8. A material instruction to the jury upon an immaterial issue will not be considered material unless it prejudiced the action of the jury in passing upon the other issues. ( S. v. Efler, 85 N.C. 585; Branton v. O'Briant, ante, 99; S. v. Credle, 91 N.C. 640; Bridgers v. Bridgers, 69 N.C. 451; Kidder v. McIlhenny, 81 N.C. 123; Williams v. Kivett, 82 N.C. 111; Gidney v. Phelps, 92 N.C. 231, cited and approved. THIS was a civil action tried before McKoy, J., at Spring (171) Term, 1884, of GUILFORD.
In such case, the deed is not color of title for any land beyond the line called for. ( Harris v. Powell, 3 N.C. 349; Fry v. Currie, 91 N.C. 436; Williams v. Kivett, 82 N.C. 111; Gilchrist v. McLauchlin, 29 N.C. 310; Corn v. McCrary, 48 N.C. 496, cited and approved.) (211) CIVIL action tried before MacRae, J., and a jury at Fall Term, 1884, of DAVIDSON.
6. The only assignments of error, which do not appear in the case on appeal, which the Supreme Court will consider, are want of jurisdiction, and that the complaint does not allege a cause of action. ( State v. Twitty, 2 Hawks, 449; Jones v. Jones, 80 N.C. 246; Young v. Lathrop, 67 N.C. 63; Worthy v. Caddell, 76 N.C. 82; Williams v. Kivett, 82 N.C. 110; Codner v. Bizzell, Ibid., 390; Drake v. CIVIL ACTION, for the recovery of land, tried before Shepherd, Judge, and a jury, at Fall Term, 1884, of the Superior Court of COLUMBUS county.
In a still later case, Milliken v. Sessoms, 173 N.C. 723, it is said: "It is settled beyond controversy in this State that a line surveyed and marked out and agreed upon by the parties at the time of the execution of the deed will control the course and distance set out in the instrument. Addington v. Jones, 52 N.C. 582; Safret v. Hartman, 50 N.C. 185; Williams v. Kivett, 82 N.C. 111."
It is settled beyond controversy in this State that a line surveyed and marked out and agreed upon by the parties at the time of the execution of the deed will control the course and distance set out in the instrument. Addington v. Jones, 52 N.C. 582; Safret v. Hartman, 50 N.C. 185; Williams v. Kivett, 82 N.C. 111. We have considered carefully all of the numerous assignments of error in the record and are of opinion that they are without merit.
The ground of exception is to be deemed on appeal a part of the exception itself. Bridgers v. Bridgers, 69 N.C. 451; Williams v. Kivett, 82 N.C. 110. See also Barnhardt v. Smith, ante, 473, as to exceptions too large and comprehensive.
