ORDER ADOPTING REPORT AND RECOMMENDATION and DISMISSING PETITION FOR A WRIT OF HABEAS CORPUS


On August 22, 2001, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that petitioner's federal application for habeas corpus relief be dismissed for failure to comply with an Order of the Court. As of this date, petitioner has not filed objections to the Magistrate Judge's Report and Recommendation.

The undersigned has reviewed the Report and Recommendation of the Magistrate Judge and has made an independent examination of the record in this case. The undersigned is of the opinion the Magistrate Judge's Report and Recommendation should be, and hereby is, ADOPTED. Accordingly, the petition for writ of habeas corpus filed by petitioner is DISMISSED.

LET JUDGMENT BE ENTERED ACCORDINGLY.

IT IS SO ORDERED.
