ORDER DISMISSING PLAINTIFF'S COMPLAINT

Marsha J. Pechman, United States District Judge.

The Court, having reviewed the Report and Recommendation of Judge Theresa L. Fricke, United States Magistrate Judge, objections to the report and recommendation, if any, and the remaining record, does hereby find and ORDER:

(1) The Court adopts the Report and Recommendation;

(2) Plaintiff's complaint is DISMISSED without prejudice pursuant to LCR 41(b)(2) for failure to prosecute; and

(3) Defendant Slothower's motion to dismiss (Dkt. 19) is DENIED without prejudice as moot.
