Williams v. First City National Bank of Oxford

Supreme Court of Alabama
Mar 23, 1984
448 So. 2d 344 (Ala. 1984)

Opinion

82-1215.

March 23, 1984.

Appeal from Circuit Court, Calhoun County; Samuel H. Monk, II, Judge.

Charlie D. Waldrep and Greggory M. Deitsch of Gorham, Waldrep, Stewart Kendrick, Birmingham, for appellant.

Michael K. Wright of Norman, Fitzpatrick Wood, Birmingham, for appellee First City Nat. Bank of Oxford.

Jake B. Mathews, Jr. of Merrill, Merrill, Mathews Allen, Anniston, for appellee Ray Parris.

Because the undisputed facts in support of Defendants' motions for summary judgment leave no genuine issue as to any material facts and entitle the Defendants to respective judgments as a matter of law as to each of Plaintiff's claims, we have no alternative but to affirm the trial court's grant of summary judgment as to each Defendant. See Hart v. General Motors Acceptance Corporation, 437 So.2d 1255 (Ala. 1983).

AFFIRMED.

MADDOX, ALMON, JONES, SHORES and BEATTY, JJ., concur.
