HENRY NORRIS WILLIAMS, ET AL v. THE DOW CHEMICAL COMPANY, ET AL


In Re: The Dow Chemical Company and ExxonMobil Corporation, applying for supervisory writs, 18th Judicial District Court, Parish of Iberville, No. 74597. BEFORE: WHIPPLE, C.J., GUIDRY AND PETTIGREW, JJ.

WRIT GRANTED WITH ORDERS. Concluding that the trial court erred in excusing two prospective jurors for cause before allowing the relators to conduct examinations as they deem necessary, as required under La. C.C.P. art 1763(B), we vacate the ruling of the trial court that excused and dismissed those jurors. The 18th Judicial District Court shall re-summon the excused prospective jurors and allow the relators to conduct such examinations as they deem necessary. La. C.C.P. art. 1763(B). If the 18th Judicial District Court is unable to recall the prospective jurors, the trial court is directed to grant a mistrial and order a new trial.
