ORDER

This appeal is from a judgment signed May 23, 2017. Appellant filed a notice of appeal on May 26, 2017. Appellant filed a statement of inability to afford payment of court costs in the trial court on April 23, 2017.

"A party who files a Statement of Inability to Afford Payment of Court Costs cannot be required to pay costs except by order of the court as provided by this rule." Tex. R. Civ. P. 145(a). "Costs" includes fees charged by the court reporter for preparation of the appellate record. Tex. R. Civ. P. 145(c). There is no contest or trial court order regarding the statement included in the record. Additionally, the bill of cost notes that the clerk's record fee was waived due to this statement.

Accordingly, the official court reporter for the County Civil Court at Law No. 3 is directed to file the reporter's record within 30 days of the date of this order.
