JUDGMENT


It is ORDERED, ADJUDGED, and DECREED that Plaintiff's Application for Attorney Fees Under the Equal Access to Justice Act be and is hereby GRANTED and that Plaintiff be awarded and EAJA attorney's fee in the amount of $994.50. No costs are taxed.

ORDER

After due and proper consideration of all portions of this file deemed relevant to the issues raised, and the Defendant having no objection, the Recommendation of the Magistrate Judge made under 28 U.S.C. § 636 (b)(1)(B) and dated the 5th day of July, 2000, is ADOPTED as the opinion of this Court. It therefore is ORDERED that the Plaintiff's Application for Attorney Fees under the Equal Access to Justice Act (Doc. 17) is GRANTED. Plaintiff is to be awarded attorneys fees in the amount of $994.50.
