APPEAL FROM THE CIRCUIT COURT OF THE FIRST CIRCUIT (SPP NOS. 07-1-0006; 07-1-0007)

ORDER DISMISSING APPLICATION FOR WRIT OF CERTIORARI

Petitioner/petitioner-appellant David V. Williams, Jr., by application for a writ of certiorari filed on October 8, 2008, seeks supreme court review of the October 1, 2008 order of the Intermediate Court of Appeals, denying petitioner's motions for appointment of counsel, for release from prison, and to expedite appeal. The October 1, 2008 order is not reviewable by the supreme court by application for a writ of certiorari. See HRS § 602-59(b) (Supp. 2007). Therefore,

IT IS HEREBY ORDERED that the application for a writ of certiorari is dismissed.
