On January 3, 2024, the Commissioner filed a Motion to Take Deposition Pursuant to Rule 74(c)(3) seeking to take the deposition of Joseph W. Schult. The Commissioner avers that Mr. Schult "has exclusive knowledge of facts of the case and respondent has been unable to obtain those relevant facts through informal and formal means." The Commissioner also informs the Court that petitioner objects. To obtain the reasons for petitioner's objection, it is

ORDERED that petitioner shall, by January 18, 2024, file a response to the Commissioner's Motion to Take Deposition Pursuant to Rule 74(c)(3) filed January 3, 2024.
