In an action to recover commissions alleged to have been earned during the term of a contract of employment, order denying motion of defendant for dismissal of the complaint on the ground of insufficiency or, in the alternative, for dismissal of so much of the complaint as seeks recovery of accrued commissions subsequent to January 1, 1941, affirmed, with ten dollars costs and disbursements. No opinion. Lazansky, P.J., Hagarty, Johnston, Taylor and Close, JJ., concur.
