DECISION & ORDER ON MOTIO

Motion by appellant, in effect, to deem an amended notice of appeal from an order of the Civil Court of the City of New York, Kings County, dated April 22, 2013, to be timely served and filed, and for a stay pending the determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion seeking, in effect, to deem the amended notice of appeal to be timely served and filed is granted (see People v Schoff, 266 App Div 158 [1943]); and it is further,

ORDERED that the branch of the motion seeking a stay is denied.
