Superior Court of New Jersey, Appellate Division
Jul 11, 1949
4 N.J. Super. 455 (App. Div. 1949)

Opinion

Argued July 6, 1949 —

Decided July 11, 1949.

Appeal from Hudson County District Court.

Before Judges COLIE, STEIN and FREUND.

Mr. James J. Langan ( Messrs. Markley Broadhurst, attorneys) argued the cause for the defendant-appellant.

Mr. Alex R. De Sevo ( Mr. Edward De Sevo, attorney) argued the cause for the plaintiff-respondent.

This appeal is from a judgment entered in the Hudson County District Court. We are asked to reverse on the ground that the judgment is so clearly against the weight of the evidence as to be without legal justification. To justify a reversal under Rule 1:2-20 it must be clear that the issue of fact determined by the court is contrary to the weight of the evidence. We do not so find.

The judgment is affirmed.
