Wiley v. State

Apr 6, 1994
634 So. 2d 314 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-1592.

April 6, 1994.

Appeal from the Circuit Court for Indian River County; Paul B. Kanarek, Judge.

Richard L. Jorandby, Public Defender, and David McPherrin, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Sharon A. Wood, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm appellant's conviction but reverse and remand for resentencing because of the error in the calculations on the sentencing guideline scoresheet as conceded by the state. We reject appellant's claim that the trial court erred in ordering restitution.

ANSTEAD, HERSEY and FARMER, JJ., concur.
