D ETTA WILCOXON v. CATHY M GARRETT

LC No. 24-007307-CZ

ORDER

Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders: The motion to waive fees is GRANTED for this case only.

The claim of appeal and related motion to expedite are DISMISSED for lack of jurisdiction. MCR 7.203(A)(1). The September 22, 2024 order is not a final order as defined in MCR 7.202(6)(a)(i) because it does not dispose of plaintiff's claims including her request for declaratory relief, violation of "Equal Protection Due Process" and statutory violations. The inclusion of final order language referring to MCR 2.602 is not controlling. See Botsford Continuing Care Corp v Intelistaf Healthcare Inc, 292 Mich.App. 51, 61; 807 N.W.2d 354 (2011). Dismissal is without prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
