Opinion

No. 05-08-00119-CV

May 9, 2008.

On Appeal from the 160th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 07-06507.

Before Justices WRIGHT, BRIDGES, and MAZZANT.

MEMORANDUM OPINION

By letter dated March 20, 2008, we sent the parties a letter questioning our jurisdiction over the appeal. Specifically, the order granting summary judgment on December 31, 2007 does not appear to be final because it did not dispose of all of the parties named in appellant's petition. Appellant filed a letter brief conceding the judgment is not final, but asks that we abate the appeal pending final disposition of the remaining claims. Appellant does not assert, however, that any hearings have been scheduled on the remaining claims that would warrant abatement for a temporary period of time. Accordingly, we dismiss the appeal for want of jurisdiction.
