ORDER

This case for the redetermination of a deficiency is before the Court on respondent's motion to dismiss for lack of prosecution, filed November 27, 2023, and heard on December 18, 2023, when the case was called from the calendar for trial at the Houston, Texas, trial session. Counsel for respondent appeared and advised the Court that relief requested in the motion need modification. There was no appearance by or on behalf of petitioner.

Upon due consideration, and for cause appearing more fully in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's motion is denied. It is further

ORDERED that on the Court's motion, this case is continued, with jurisdiction retained by the undersigned.

The parties should expect this case will be set for trial during the Court's 2024 spring term.
