Before the Court is appellee's December 7, 2023 motion to dismiss this appeal based on appellant's failure to (1) provide notice he has requested the reporter's record; (2) file the appeal within ten days of judgment; and (3) pay the supersedeas bond. We DENY the motion.
Although appellant's failure to provide notice he has requested the reporter's record is not cause for dismissal, it is cause for submitting the appeal on the clerk's record alone. See Tex. R. App. P. 37.3(c). Having cautioned appellant by letter dated November 27, 2023, that failure to verify with the Court within ten days that he had requested the reporter's record would result in the appeal being submitted without it, we ORDER the appeal submitted on the clerk's record alone. See id.
The clerk's record having been filed, we ORDER appellant to file his brief on the merits no later than January 22, 2024.
We DIRECT the Clerk of the Court to send appellant a paper copy of the Court's "Information for People without Lawyers" Handout.
