This case is calendared for a standalone remote trial at the session of the Court scheduled to commence on October 31, 2022.
On October 13 and 20, 2022, the Court conducted conference calls with the parties. During those conference calls, the parties discussed the current status of this case and their efforts in working together to prepare this case for trial. They also discussed respondent's first request for admissions, the parties' first stipulation of facts, and the status of unagreed exhibits. On October 26, 2022, the Court conducted an additional conference call with the parties. During that conference call, the parties updated the Court of their ongoing efforts to prepare this case for trial and requested additional time to do so. They also updated the Court on their efforts to stipulate to the unagreed exhibits in a second stipulation of facts. The Court noted a problem with the number of the current unagreed exhibits.
Accordingly, it is
ORDERED that this case is stricken from the Court's October 31, 2022, standalone remote trial session and is continued. It is further
ORDERED that, on or before November 10, 2022, the parties shall file with the Court a second stipulation of facts attaching all agreed and unagreed exhibits that will be offered into evidence at trial, except for the documents already included in the first stipulation of facts and any documents that may be used for rebuttal or impeachment (the "second stipulation of facts exhibits"). All second stipulation of facts exhibits will be attached to the second stipulation of facts and the parties will note all, if any, of their objections to each document. Documents that are not attached to the first or second stipulation of facts or that are not used solely for rebuttal or impeachment may not be separately offered into evidence. It is further
ORDERED that this case is calendared for remote trial at the session of the Court scheduled to commence on November 14, 2022, for cases in which Richmond, Virginia, is listed as the place of trial. It is further
ORDERED that this case is set for remote trial at a time and date certain of 10:00am EST (9:00am CST) on Tuesday, November 15 through Thursday, November 17, 2022. It is further
ORDERED that the Clerk of the Court shall serve a Notice of Remote Proceeding to the parties that shall contain comprehensive instructions on how to participate in the above-referenced remote proceeding. It is further
ORDERED that the standing pretrial order issued April 28, 2022, remains in effect. It is further
ORDERED that, on or before November 7, 2022, the parties shall file a joint status report reflecting the then-present status of this case. It is further
ORDERED that jurisdiction is retained by the undersigned. This order constitutes official notice to the parties.
