Widmer v. State

District Court of Appeal of Florida, First District
Nov 17, 1999
747 So. 2d 411 (Fla. Dist. Ct. App. 1999)

Opinion

No. 97-4015.

Opinion filed November 17, 1999.

An appeal from the Circuit Court for Alachua County. Elzie Sanders, Judge.

Albert Widmer, Appellant, Pro Se.

Robert A. Butterworth, Attorney General; Giselle Lylen Rivera, Assistant Attorney General, Tallahassee, for Appellee.

Albert Widmer, appellant, seeks review of a trial court order denying Widmer's motion filed pursuant to Florida Rule of Criminal Procedure 3.800(a). Because the question presented in the rule 3.800(a) motion involves the same issues which were decided in Widmer's direct appeal in this court's Case No. 98-73, we dismiss the instant appeal.

Accordingly, this appeal is dismissed as moot.

LAWRENCE and VAN NORTWICK, JJ., CONCUR.
