This case was set for trial at the Court's June 8, 2020, Tampa, Florida trial session that was cancelled due to concerns relating to coronavirus (COVID-19), and assigned to the undersigned. The parties have filed a Stipulation of Settled Issues and the Commissioner's proposed Stipulation of Facts and First Supplemental Stipulation of Facts and exhibits referred to in and attached to his Motion for Order to Show Cause Why Proposed Facts and Evidence Should Not Be Accepted as Established Pursuant to Rule 91(f) are deemed to be established for purposes of this case. On August 29, 2022, the Court held a conference call with the parties to discuss the status of the case and to set the case for trial. Upon due consideration, it is
ORDERED that this case is set for trial at a remote Special Session scheduled to commence on Monday, February 6, 2023, at 10:00 am (Eastern time). Tampa, Florida shall be listed as the place of trial for this remote Special Session, however the session will occur remotely. It is further
ORDERED that the Clerk of the Court shall issue a Notice of Remote Proceeding to the parties that shall contain comprehensive instructions on how to participate in the above-referenced remote proceeding. It is further
ORDERED that Mr. Widman shall, by September 30, 2022, file a pretrial memoranda. It is further
ORDERED that Mr. Widman shall, by January 13, 2023, file a status report identifying any additional witnesses for trial and whether any additional documents have been provided to the Commissioner.
