ORDER OF DISMISSAL


On December 18, 2002, this Court issued an Order requiring pro se plaintiff Steve Whiting ("Mr. Whiting") to file an amended complaint curing certain deficiencies in his complaint by January 20, 2003. The December 18 Order stated that if Mr. Whiting failed timely to file an acceptable amended complaint, the action would be subject to dismissal.

The deadline for filing an amended complaint having passed without the submission of such a complaint, the Court DISMISSES this action without prejudice pursuant to 28 U.S.C. § 1915 (e)(2)(B)(i)-(iii) and Fed.R.Civ.P. 12(b)(1), (6). The Clerk of the Court is directed to send a copy of this Order to Mr. Whiting.
