ORDER OF REMAND

After reviewing the motion and stipulation presented by the parties, and pursuant to 28 U.S.C. § 1367 (c) and 1447(c),

IT IS ORDERED that the above-captioned action shall be and hereby is REMANDED to the Fourth Judicial District Court for Utah County, State of Utah.

The Clerk of the Court shall forthwith transmit a certified copy of this Order to the Clerk of the Fourth Judicial District Court, together with any original pleadings or papers received from that court upon the removal of the action to this court. The Clerk shall retain all pleadings and papers filed with this Court in this proceeding.
