Order denying a preference to the plaintiff in a tort action reversed on the law and the facts, without costs, the motion granted, without costs, and the case set down for trial the first Monday of February, 1943. The showing of destitution is complete and, in the opinion of this court, the motion should have been granted. Lazansky, P.J., Hagarty, Carswell, Adel and Taylor, JJ., concur.
